Terms & Conditions

These terms govern your use of TableSpark — the website builder and hosting platform we provide for restaurants. By creating an account or using the service, you agree to them.

1Agreement to these terms

TableSpark ("TableSpark", "we", "us") operates tablespark.uk, a platform that lets restaurants build, publish and manage a website. By creating an account, or by accessing or using the service, you confirm that you accept these Terms & Conditions and agree to comply with them. If you do not agree, please do not use the service.

These terms work together with our Privacy Policy, which explains how we handle personal data.

2Your account

You must be at least 18 years old and able to enter into a contract to open an account. The details you give us when registering must be accurate and kept up to date.

You are responsible for keeping your password confidential and for all activity that happens under your account. Tell us promptly at hello@tablespark.uk if you think your account has been accessed without your permission. You can delete your account at any time from your settings, which permanently removes your account and the sites you own.

3Acceptable use

You agree not to use TableSpark to publish or do anything that is unlawful, or that you don't have the rights to. In particular, you must not:

  • upload content that is illegal, infringes someone else's intellectual property, is defamatory, or is otherwise objectionable;
  • misrepresent a business you don't own or operate;
  • attempt to break, overload, probe or gain unauthorised access to the platform or other users' data;
  • use the service to send spam or to process personal data in breach of data-protection law.

You are responsible for meeting the laws that apply to your own business, including displaying accurate pricing, allergen information and any required business details on your site.

4Your content

Everything you add — your menus, photos, text, logo, opening hours and contact details ("your content") — remains yours. You grant us a licence to host, store, reproduce and display your content only as needed to provide and promote the service to you and to publish your site.

You confirm you have the rights to everything you upload, and that publishing it doesn't break the law or anyone else's rights. You can edit or delete your content at any time; deleting a site removes its content, leads and analytics.

5Plans, billing & cancellation

Paid plans are billed in advance on a recurring basis (monthly unless stated otherwise) through our payment provider; card details never touch our servers. Prices are shown on our Pricing page and, where indicated, exclude VAT.

You can change or cancel your plan at any time. Cancelling stops future charges; we don't provide pro-rata refunds for a period already started unless the law requires it. We may change prices with reasonable notice, and any change applies from your next billing period.

6Availability & changes

We work hard to keep TableSpark available and reliable, but we don't guarantee it will be uninterrupted or error-free. We may update, improve or change features over time, and occasionally take the service down for maintenance. We'll try to give notice of anything significant.

7Suspension & termination

We may suspend or close an account that breaches these terms, that we're required to act on by law, or that puts the platform or other users at risk. Where it's reasonable to do so, we'll contact you first. You may close your account at any time. On termination, your right to use the service ends and your sites go offline.

8Our intellectual property

The TableSpark platform, its software, design, templates and brand belong to us or our licensors. Using the service doesn't transfer any of those rights to you beyond the licence needed to run your site while your account is active.

9Liability

Nothing in these terms limits liability that can't be limited by law (such as for death or personal injury caused by negligence, or fraud). Subject to that, TableSpark is provided "as is", and to the extent permitted by law we're not liable for indirect or consequential loss, lost profits, or loss of data. Where we are liable, our total liability to you is limited to the amount you paid us in the 12 months before the claim.

You're responsible for your own content and your relationship with your guests; we act only as the platform that hosts your site and, for guest data, as your data processor as described in the Privacy Policy.

10Data protection

How we handle personal data — yours as a customer, and your guests' as a processor on your behalf — is set out in our Privacy Policy, which forms part of these terms.

11Changes to these terms

We may update these terms from time to time. If we make a material change we'll let you know (for example by email or a notice in the app) before it takes effect. Continuing to use TableSpark after a change means you accept the updated terms.

12Governing law & contact

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. You can reach us any time at hello@tablespark.uk.
